§ 01 — Underwriting

Four lines. No exceptions.

65% LTV
or better.

Loan-to-value capped at sixty-five percent of as-is appraised value. Conservative basis protects principal in every market cycle.

— II.

11 Months
or less.

Bridge and gap terms structured for clarity and exit. We lend short, settle clean, and move on.

— III.

1st Position
preferred.

Senior security is the goal. 2nd and 3rd lien positions are considered, but require a deed-in-lieu of foreclosure executed at closing and an accredited-investor / no-duress acknowledgment. We close eyes-open on both sides.

— IV.

Cross-Collateralized,
when warranted.

Additional collateral may be cross-pledged to strengthen structure. Sponsors with depth find us flexible.

Terms of Engagement
A.

Extension

A one-month extension may be granted at the lender's sole discretion for one (1) additional point. Pricing floor: 10.00% per annum.

B.

Default & Cure

Each missed monthly payment constitutes a default event, carrying a 24%–29% default interest rate. Three (3) consecutive missed payments constitute material default.

C.

Subordinate Lien Protections

2nd and 3rd lien positions carry inherent risk and frequently fall off in subordination. To proceed, we require a deed-in-lieu of foreclosure executed at closing as protection for principal.

D.

Accredited Investor & No-Duress

All borrowers execute an acknowledgment of accredited-investor status and that the transaction is entered into free of duress. Required on every deal, no exceptions.

E.

Profit-Split Provision

Where the underlying property sits well below LTV thresholds, a profit-split arrangement may be structured in lieu of strict enforcement. Our model rewards long-term sponsor relationships — we don't need to take everything to win.
